eBay Copyright Thieves & Crooks Named and Shamed
It's dishonest to copy photographs, and misleading to buyers.

beata9898 Using Copied Sovereign Images on eBay
eBay seller beata9898 of London, London, United Kingdom, not only stole our 1891 Victoria Jubilee Head Uncirculated Sovereign Obverse image without permission, but failed to tell buyers his coin was not the same coin.

High eBay Feedback is No Guarantee of Integrity or Honesty
When we wrote this page, this eBay member's feedback was 7; with 100% positive according to eBay.
It also demonstrates that high eBay feedback is no indicator of honesty.

What's Wrong?
We invest a great deal of time, effort, and cost into creating some of the best photographic coin images on the internet. We strongly object when lazy and dishonest people decide to use them without a by your leave or thanks, doing so in competition with us.
Copyright theft is dishonest. We recommend you avoid doing business with dishonest dealers.
This particular eBay seller not only stole our high quality images of a rare mint condition 1891 Victoria Jubilee Head Short Tail Horse Sovereign, he or she failed to state that the coin shown in the photographs was not the same coin he was selling.
It was nice enough of her to place a reference on her listing to our relevant web page, but was she trying to suggest hers was the same rarity?

Price
The seller was asking a starting price of 100 for this listing.
Whatever the items "sell" for, after eBay's greedy 10% selling fees, and possible PayPal charges, the crook may have been much better off selling the coins to us, instead of stealing our photographs.

eBay Guilty of Negligence or Complicity
We will be reporting this example of copyright abuse using our standard Statutory Declaration via the eBay VeRO programme, and wait to see if they chose to action or ignore our report. We look forward to taking legal action against eBay for their negligence and / or complicity if they fail to take down the offending material promptly.

Ignored
We sent a "Notice of Claimed Infringement - Statutory Declaration" to eBay about this listing, on 22nd July 2010.
We sent another report to them on 25th July
By 28th July, we had received no response from eBay's VeRO department about this listing, despite them responding to others. This is not the first time eBay have ignored or failed to respond to our NOCI (as they call them) reports, so today we sent a third e-mail asking politely if there was any particular reason they had chosen to ignore our repeated legal notices.
We await their response, and will report it here in due course.

eBay Still Don't Get It

eBay United Kingdom Customer Support (vero) wrote: Hello,
Thank you for sending us your Notice of Claimed Infringement -- Statutory Declaration (NOCI).
Unfortunately it isn't clear in the NOCI what your intellectual property claim is. We need some more information to help us investigate. You included 3 different reason codes in when you e-mailed us your NOCI.
Please reply to this email with more details about the intellectual property rights you hold and how these listings infringe your rights. When we receive your response we'll be happy to review this matter again.
Thank you for your cooperation. We look forward to receiving your reply.
Kind regards,

Dear Oscar,
Thank you for your response.
"Unfortunately it isn't clear in the NOCI what your intellectual property claim is."
This fails to explain why we got no response to our first two e-mailed NOCI reports, even if it was your "Re: eBay VeRO Program - NOCI Received - More Information Requested" response.
This caused us to assume that you were simply ignoring our NOCI reports.
"You included 3 different reason codes in when you e-mailed us your NOCI."
*Reason Code*:
*CopyrightInfringing **/Listing /**Content *
4.2 Listing(s) uses unauthorized copy of copyrighted image
or
4.1 Listing(s) uses unauthorized copy of copyrighted text
or
4.3 Listing(s) uses unauthorized copies of copyrighted image and text
Two of the three listing codes include "unauthorized copy of copyrighted image"
We also stated "... for which they are using copied images, they may be falsely misrepresenting the condition of the coins offered,..."
and "Please also note that most of our images can be identified and verified by the presence of a Digimarc watermark."
We also supplied you with a link to our page:
https://goldsovereigns.co.uk/beata9898.html (this page)
which not only gives you further information, stating inter alia
"beata9898 Using Copied Sovereign Images on eBay
eBay seller beata9898 of London, London, United Kingdom, not only stole our 1891 Victoria Jubilee Head Uncirculated Sovereign Obverse image without permission, but failed to tell buyers his coin was not the same coin."
but also included a copy of our original photograph, and a link to the page from which she most likely lifted it.
We have in the past few months tried to include a link to our specific name and shame page in all our NOCI reports which contain detailed but simple expositions of our reason(s) for reporting the copyright abuse.
In case this leaves you in any doubt, we will restate here:
4.2 Listing(s) uses unauthorized copy of copyrighted image

Selling Gold Sovereigns & Other Coins on eBay
We point out that sellers may often get more money, for less effort, by selling to a specialised dealer, such as us, rather than via eBay.
